DUGAN WON"T STOP CITY RENTAL INSPECTION LAW IMPLEMENTATION
JUDGE SAYS "NO" TO T R O

Hon. Timothy G. Dugan [Marquette U '78] today, Wednesday December 30th, 2009, denied an ex-parte motion for a temporary restraining order preventing the City of Milwaukee from implementing its controversial rental inspection legislation. [Common Council Ordinance 090429].
It was the first step in a lawsuit filed in Milwaukee County Circuit Court yesterday, Tuesday, December 29th, 2009, challenging the recently passed City of Milwaukee pilot program requiring licensure of certain rental residential properties.
The case, Joseph Peters et al vs. City of Milwaukee et al, [Milwaukee County Case Number 2009CV020225], is assigned to the Branch 22 Court of Hon. Tim Witkowiak [Marquette U '84].
The plaintiffs are Joseph Peters of Milwaukee, Tomika Culpepper of Detroit and Salida Properties LLC of Brookfield.
All are represented by attorneys David Roland Halbrooks [U Wisconsin '87] and Matthew D. Lerner [Marquette '06], who could probably tell you who these folks are, since I never heard of them.
The defendants are the City of Milwaukee [a Municipal Corporation chartered in 1846], the City of Milwaukee Common "Counsil" [a misspelling of the name of the state's noblest deliberative body], the City of Milwaukee Dept. of Neighborhood Services and Arthur Dahlberg, its commissioner.
The City, its entities and agents are represented by Atty. Adam B. Stephens [U Wisconsin '99].
