NASCAR'S KENSETH FIGURE IN REOPENED PATERNITY CASE

[Updated May 31st, 2007]Thirteen years after it was settled, a paternity suit naming NASCAR racer Matt Kenseth was reopened in Calumet County Circuit Court for “post judgment adjudication,” at the request of Lisa M. Winius, the mother of Kenseth’s son Ross.
Case Number 1993PA000080PJ, “In Re the Paternity of RJK,” is scheduled for a court trial in Chilton on June 6th. Kenseth, 35, a native of Cambridge, was a racing prodigy who continues to enjoy unrivaled success on the oval track. In 1994 he was the youngest-ever winner of the prestigious Miller Genuine Draft Championship. He now lives in North Carolina.
Kenseth has winnings of $2,039,373 thus far in the 2007 season, which is only about a third finished, and which may explain why a thirteen year old paternity case was reopened.
According to state law, the custodial parent of an only child is set to receive 17 per cent of the income of the non-custodial parent. According to these figures, Ms. Winius should have received about $346,730 for the first five months of this year, which would be enough to get the attention of a good family lawyer. (Winius is represented by Neenah attorney William J. Hammett.)
And, it does appear that money is the issue in this case.
On January 4th, 2007, Kenseth’s attorney, Daniel R. Cross of the Appleton firm of Peterson, Berk and Cross, filed a request to “name expert witness to give evidence on racing costs,” which would appear to be an attempt to mitigate the support costs Kenseth is obliged to pay. (Cross did not return an e-mail asking for comment.)
SON A RACER, TOO
Ross Kenseth, born May 25th, 1993, and the subject of the suit, has followed in his father’s precocious racing footsteps, it appears. He already has a website and a fan club, and he promises a line of merchandise will be forthcoming soon. He’s giving his dad a run for the money in the sponsorship game (everybody knows that’s where the real NASCAR cash lies), having lined up such firms as Fast Signs, Appleton, Rockford Industrial Welding Supply, Inc. and AirTest Technologies, Inc. He promises to race late model cars with his dad this summer (time and places to be announced) and says he is “carrying #20 on his car again this year to show his appreciation for his favorite Cup driver, Tony ‘Smoke’ Stewart and Smoke’s father Nelson, who make his racing possible. … Ross Kenseth Racing is actively seeking sponsors for the 2007 season.”
Maybe mom is suing the wrong guy for support!

another money grabbing woman who wants to milk somone she did 15 yrs ago and agreed to a settlement. shes not wanting the money for her son. shes wanting life on easy street so she can be a 'trophy' mom on her sons racing circuit.
she probably has lived off of Kenseth her entire adult life and im wondering why theres no mention of her job or career. could it be she has neither??

That is too cute that his favorite driver is Smoke! But no way he could be Smoke's kid. He looks just like Matt but it's neat that Nelson Stewart (Smoke's dad) has helped the young man. I hope he turns out to be a combination between Smoke and Matt in his driving and personality.
If they are going to get Matt's money the least the kid can do is put a 17 on his racer and claim his dad is his favorite NASCAR driver! So much for blood being thicker than water...
Obviously, there are some issues between Matt Kenseth and his son...if Ross and "Dad" had a good relationship, then Matt might be his fave driver, but he's not...so maybe his parenting skills should be questioned and not his ex's motives for hauling his deadbeat ass back to court :)
I have to agree with you! In my opinion, Matt seems to not care about Ross or Ross's racing career! If anyone watched the Nextel Cup race back in the Fall of 2005 at Bristol when Matt won, Ross was congratulating "Dad" on his win back you know what Matt did? Ignored Ross and went straight to his dad and his wife! So there is something wrong between the 2. I have been wondering alot about this situation and Ross's mom. I hope I can learn more real soon. I just can't trust Matt or his ex!
I have been watching Nascar most of my life and I have never heard Matt make mention of a son I was shocked when I saw him at Tony's dirt track and the way he treated him he never introduced him acted as if he didnt exist. I think he should have to step up and be a man and take care of his child, I dont blame the kid for supporting Tony he showed him more respect than his dad. I wish him well and cant wait untill the day I get to see him beat his dad on the track.
Ross and Matt have a good relationship and are together several weekends a year. If you read his website he said he does not race for points as he is with his dad. The law allows Lisa to get this amount as long as it is used for Ross. What are you worried about TRUST for .... get a life!
ross gets along just fine with his father.
my uncle owns a track here in michigan and they come race here in the ASA model series. and ross is not number 20. he is number 25 which is the numbers 8 (his dads original late model number) and 17 which is his number now. its also his birthday.
i go to school with ross kenseth. i pooped next to him in the bathroom today.
